Immigration related costs to bring grant post-docs onboard

Appointment of faculty, post-docs, pre-docs, and post-bacs is contingent upon their eligibility for employment in the United States. If there are legal and filing fees associated with securing an H1-B visa for a grant sponsored faculty, post-doc, pre-doc, and post-bac, the PI:

  1. Should share the index to charge immigration expenses such as visa fees with the A&S Dean’s office and HR
    1. The A&S Dean’s office share this information with legal counsel to allow correct allocation of expenses
  2. Can use the index for PI’s research incentive and / or the grant for such expenses (assuming the grant allows for such expenses to be charged)
  3. Should be aware that the Dean’s office is not responsible for immigration related fees for grant post-docs. If the PI needs help with such costs, they should contact the Dean’s office for approval before such hire (similar to the pre-approval process that is followed for cost shares).

Federal guidelines require the University (or the grant) to pay for the legal and filing fees associated with securing an H1-B visa for all sponsored faculty, post-doc, pre-doc, and post-bac employees, including those funded by a grant. PI cannot ask researcher to reimburse.
